These General Contracting Conditions (hereinafter, General Conditions) regulate the process of purchase and sale of the products offered by BODEGAS HEREDAD DE BAROJA, S.L. in the catalog available in its web page www.lardepaula.com.
The General Conditions bind BODEGAS HEREDAD DE BAROJA, S.L., and the buyer (Customer), granting them a series of rights and obligations, from the moment the latter places and accepts an order through this page. They are of obligatory fulfillment and knowledge by both parts, reason why its acceptance is essential to be able to formalize an order. Therefore, the Customer must read these conditions carefully.
These General Conditions shall be governed by the provisions of the legal regulations in force.

CLIENT
Any User of the website www.lardepaula.com who places an order and accepts it at the time of placing the order shall be considered a Customer.
The Customer may purchase as a guest or register as such, in both cases, must provide the following information to place the order: name and surname or company name, NIF / ID, billing address, delivery address, contact telephone and email contact.
This data will be treated in accordance with the stipulations of the “Privacy Policy” (include link).
2. OBJECT OF THE CONTRACT
To regulate the sale and purchase of the products offered by BODEGAS HEREDAD DE BAROJA, S.L. in its Web Page by the Customer.
3. BIDDING PROCESS

Each product has a product description and its selling price including VAT.
The final purchase price of a product or its shipping costs may vary depending on the destination region of the product, or the method of payment, since depending on the geographical area where it is sent may vary the costs. 4. ACCEPTANCE OF THE OFFER
It occurs at the moment in which the Customer gives his express consent to the order placed, and after the acceptance of the General Conditions.
At the moment of activating the order the client formalizes a contract of purchase of the selected product with BODEGAS HEREDAD DE BAROJA, S.L. acquiring the rights and commitments established in the applicable regulations and those exposed in these general conditions of contracting.
5. PAYMENT OF ORDERS
The fact that the order is placed means that the product is reserved. The moment the payment is made is when the purchase is materialized.
In the event that you make the payment by Visa card and at that moment the product is not in stock, we will contact you to inform you of the situation and inform you of the next availability of the product or, if necessary, to proceed with the cancellation of the order and the corresponding refund of the amount.

The customer will select the payment method chosen from those available at the time of purchase.
Payment by credit card:
The customer may choose to pay by credit card, and the transaction will be made at the time the order is placed. Only Visa and Mastercard cards protected by Verified Visa are accepted. If the customer’s card is not registered by Verified, the customer will have to consult with his bank in order to register it.
6. DELIVERY TIMES OF ORDERS
The delivery times of the orders depend on the stock that will be informed on the web. In case the product is in stock, the orders will be delivered within 5 days from the formalization of the order.
The orders will be delivered by a transport company to the delivery address indicated by the Client and to the person who has been designated as the recipient of the orders. This information will be recorded on the delivery note of the transport company. In addition to the delivery note, a purchase invoice will be delivered to the Customer with each order, either inside the shipping package or together with the shipped product. In some cases, it will be sent via e-mail or regular mail.
If the invoice is missing, the Customer may request it by e-mail to the address info@lardepaula.com indicating the name of the invoice holder and the order number, and it will be sent to the invoice address by regular mail or e-mail.
7. PRODUCT WARRANTY
The legal framework of warranty (RDL 1/2007, of November 16, which approves the Revised Text of the General Law for the Defense of Consumers and Users and other complementary laws) aims to provide the Customer with different options to demand the remedy when the purchased good does not conform to the contract, giving the option to demand the repair or replacement of the good, unless it is impossible or disproportionate. When repair or replacement is not possible or is unsuccessful, the consumer may demand a price reduction or termination of the contract. It is recognized a period of two years from the time of purchase for the Customer to enforce these rights (provided that the product has manufacturing defects and not by the mere wear of it) and a period of three years, also counted from the time of purchase, so you can exercise, if necessary, appropriate legal action. In any case, the warranty of the brand or manufacturer shall apply.
By virtue of this, BODEGAS HEREDAD DE BAROJA, S.L. shall be liable to the Customer for any lack of conformity existing at the time of delivery of the products of the order, understanding these as tangible goods intended for private consumption.
In order to be able to make use of this guarantee, the Client will have to contact BODEGAS HEREDAD DE BAROJA, S.L. by e-mail to the address info@lardepaula.com in which he will indicate: name of the holder of the order, order number, invoice number and cause of the nonconformity.
No warranty cases will be accepted when the products have been used improperly or not in accordance with their characteristics by the Customer.
For all aspects of the commercial guarantee referred to in Article 123 of the Revised Text of the General Law for the Defense of Consumers and Users and other complementary laws, approved by Royal Legislative Decree 1/2007, the contents of Law 7/1996, of January 15, on the Regulation of Retail Trade, shall be applicable.
8. RETURNS AND EXCHANGES
The Customer has the right to withdraw from the order within 14 calendar days of receipt of the order. Out of the above mentioned term, revocations of orders will not be accepted, not even on orders of supply of goods made according to the specifications of the Client or clearly personalized, or that, for his nature, cannot be returned or can deteriorate or expire quickly, etc. that had been unsealed and / or used by the Client. The Client will have to communicate his withdrawal to HEREDAD DE BAROJA, S.L. across the Form of Withdrawal by means of e-mail, post or fax, inside this term of 14 days. The cost of the shipments of the returns will be paid by the Client. The products must be in the same condition in which they were received, with the original packaging and may not have been used. The refund will be made in the same means of payment that was used by the Customer.
To proceed with the exchange or return, the products must be in the same conditions in which they were received, with the original packaging and must not have been used.
9. NOTIFICATIONS
For the effects of notifications, requirements and writings of any kind to which the present contract gives rise, the address of BODEGAS HEREDAD DE BAROJA, S.L. shall be understood as the address indicated in the present General Conditions.
10. VALIDITY OF THE CLAUSES
Even if a clause of this contract or one of its parts is declared invalid or unenforceable, the remaining clauses or parts thereof shall continue to be valid and shall remain in force.
11. APPLICABLE REGULATIONS
These General Conditions are governed by current Spanish legislation, and specifically by: Civil Code, Texto Refundido de la Ley General para la defensa de los Consumidores y Usuarios y otras leyes complementarias; Ley 7/1998 de 13 de abril de Condiciones Generales de la Contratación; Law 7/1996 of January 15, 1996 on the Regulation of Retail Trade, Directive 2000/31 EC of the European Parliament and of the Council, of June 8, on certain legal aspects of information society services, in particular electronic commerce in the internal market (Directive on electronic commerce); Law 34/2002 of July 11, 2002 on Information Society Services and Electronic Commerce; and the regulations that develop them.
12. CLAIMS
In accordance with Decree 142/2014, of July 1, on consumer complaint forms and the procedure for handling complaints, claims and denunciations of consumers and users, there are complaint forms available to our Clients at the address of BODEGAS HEREDAD DE BAROJA, S.L.
